About the Community Trade Mark

The adhesion of Romania into the European Union has constituted the beginning of new business opportunities for the Romanian companies, facilitated by the easier access on the Community space markets. On the other hand, the adhesion has brought essential modifications in the field of trademarks, determining the Romanian companies to adopt a new approach in protecting their rights. Therefore, inside the Romanian business environment has become more and more present the concept of Community Trade Mark, as a solution for the Romanian companies' needs for protection within their expansion towards the Community market.

The need for a unitary system

The common market established by the European Union, characterized by the free movement of goods, individuals, services and capital within, has led to the creation of a new concept, meant to answer the need for uniform protection of companies in the new Community business environment context: the Community Trade Mark.

Thereby, a uniform protection instrument for their rights has been provided to companies within the European Union, by means of a single registration, as an alternative to the national registration in each member state, or the international registration according to the Madrid system.

The main advantage insured by the Community Trade Mark is represented by the easiness of pursuing a single registration procedure, before a single European institution, while the rights acquired are equally valid in all the member states of the European Union.

What is the Community Trade Mark?

The Community Trade Mark is the title granted by the (European) Office for Harmonization in the Internal Market as a consequence of filing a trademark application before this institution and pursuing the registration procedure, according to the Council Regulations on the Community Trade Mark.
